ملخص الدراسة:

The issue of using the orphans’wealth is considered among the most important practical issues in Fiqh that is needed to be clarified in the Palestinian society.This is due to the increasing numbers of martyrs as a result of the continuing Israeli wars and attacks against the Palestinian people. In this context, this study titled “Practicing Mudarabah by the guardian, Wali, for himself in the orphan’s wealth” aims to address this issue through clarifying the concept of Mudarabah, its pillars, and conditions. This is followed by clarifying the nature of the Wali’s authority in the orphan’s wealth, and to which extent this Wali has the right to use this wealth in the practice of Mudarabah for his own benefit. The study also presentsthe Islamic objectives that the Wali may achieve through this practice assuming that it is a permissible one. The study concludes by clarifying the Islamic criteria to develop orphans’fundsand protect them from the greed and desires of their Walis.
